Terms of Use (EULA)

This End User License Agreement (“Agreement” or “Terms of Use”) is a legal agreement between you (“You” or “User”) and Chomp AI LLC (“Company,” “We,” “Us,” or “Our”) governing your use of the Chomp AI mobile application (“App”) and the website at chompai.app (“Website”), collectively referred to as the “Service.”

By downloading, installing, or using the App, or by accessing the Website, you agree to be bound by these Terms of Use. If you do not agree, do not use the Service.

1. Description of Service

Chomp AI is an AI-powered nutrition tracking application. Users can photograph food and the App uses artificial intelligence to estimate calories and macronutrients (protein, carbohydrates, and fat). The Service also includes nutrition goal tracking, progress monitoring, and personalized recommendations.

The nutritional information provided by the Service is an estimate generated by AI and should not be considered medical or dietary advice. Always consult a qualified healthcare professional for dietary guidance.

2. Subscriptions and Payment

2.1 Subscription Plans

Chomp AI offers the following auto-renewable subscription plans:

• Annual Plan: $29.99 per year ($2.49 per month equivalent) with a 3-day free trial
• Monthly Plan: $7.99 per month

Both plans provide full access to all Chomp AI features, including AI food scanning (up to 16 scans per day), nutrition tracking, progress monitoring, and personalized goals.

2.2 Free Trial

The Annual Plan includes a 3-day free trial. You will not be charged during the trial period. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription, and payment will be charged to your Apple ID account.

2.3 Billing and Auto-Renewal

Payment will be charged to your Apple ID account at the confirmation of purchase. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price.

2.4 Managing and Canceling Subscriptions

You can manage or cancel your subscription at any time through your Apple ID account settings. Go to Settings > [Your Name] > Subscriptions on your iOS device to manage your subscription. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.

2.5 Price Changes

We reserve the right to change subscription prices. If we change the price, we will notify you in advance and give you the opportunity to accept the new price or cancel your subscription before it renews at the new rate.

3. Account and Authentication

To use certain features of the Service, you must create an account using Sign in with Apple or Sign in with Google. You are responsible for maintaining the security of your account and for all activities that occur under your account.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms
• Attempt to reverse-engineer, decompile, or disassemble the App
• Interfere with or disrupt the Service or its servers
• Share your account credentials with third parties
• Upload content that is harmful, offensive, or violates the rights of others
• Circumvent any usage limits or restrictions imposed by the Service

5. User Content

You retain ownership of all content you upload to the Service, including food photos and nutrition data. By using the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, host, store, reproduce, modify, and create derivative works from your content solely for the purpose of operating, improving, and developing the Service.

This license includes the right to use your content in an anonymized or aggregated form. We will not publicly associate your content with your identity without your explicit consent.

6. Intellectual Property

The Service and its original content (excluding user-provided content), features, and functionality are and will remain the exclusive property of Chomp AI LLC. The Service is protected by copyright, trademark, and other applicable laws.

7. Disclaimer of Warranties

The Service is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind. The Company does not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

AI-generated nutritional estimates are approximations and may not be accurate for all foods. The Service does not provide medical advice. You should not rely solely on the Service for dietary or health decisions.

8. Limitation of Liability

To the maximum extent permitted by law, Chomp AI LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

9. Termination

We may terminate or suspend your access to the Service immediately, without prior notice, if you breach these Terms. You may delete your account at any time through the App settings or by contacting us. Upon termination, your right to use the Service ceases immediately, but your obligation to pay any outstanding charges survives.

10. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

11. Third-Party Services

The Service may integrate with third-party services, including Apple's App Store for payments and Google services for AI analysis. Your use of such third-party services is subject to their respective terms and conditions.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions.

13. Dispute Resolution

If you have any concern or dispute about the Service, you agree to first try to resolve the dispute informally by contacting us at support@chompai.app.

14. Changes to These Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you through the App or by other means. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
